Das Recht auf Einwanderung und das Recht auf Ausschluss

Der vorliegende Aufsatz setzt sich mit der moralischen Begründung zweier, gemeinhin als widersprüchlich aufgefasster Rechte auseinander: das Recht auf Einwanderung und das (demokratische) Recht auf Ausschluss. Es wird gezeigt, welche Funktion diese Rechte jenseits jeder konsequentialistischen Logik ausüben können. Die Begründung beider Rechte ist an die Idee der individuellen Autonomie angelehnt. Demnach eröffnen diese Rechte Freiheitsräume, innerhalb derer Menschen autonom entscheiden dürfen, wie sie ihr Leben gestalten oder welche (politischen) Ziele sie verfolgen wollen. Im letzten Teil des Aufsatzes wird schließlich dargelegt, weshalb das Recht auf Ausschluss dem Recht auf Einwanderung nicht widerspricht.
This paper addresses the moral justification of two putatively contradictory rights: the right to immigration and the (democratic) right to exclude. It investigates their functions (consequentialist considerations aside) and anchors their justification on the idea of individual autonomy. Accordingly, these rights are thought to offer a range of options within which people can decide autonomously how they organize their lives or what (political) goals they wish to pursue. In the last part of the paper it will be argued that the right to exclude does not contradict the right to immigration.
