Rechtsstaat und Grundrechte in der Corona-Krise

Abstract: Die Coronapolitik hat einen verfassungsrechtlichen Ausnahmezustand geschaffen. Denn die grundlegenden rechtsstaatlichen Regeln, die im Normalzustand das Verfassungsleben bestimmen, wurden in ihr Gegenteil umgestülpt. Der Vortrag begründet diese These und zeigt die Konsequenzen für die rechtliche Beurteilung der Corona-Maßnahmen anhand des Verhältnismäßigkeitsprinzips auf. Er schließt mit der Aufforderung, die fortbestehenden Reste des Ausnahmezustands konsequent zu beenden, da keine Notstandslage mehr bestehe
Abstract: The Corona policy has created a constitutional state of deviation from the normal state of affairs. This is because the fundamental rules of the rule of law that govern constitutional life in a normal state of affairs have been turned upside down into their opposite. The lecture substantiates this thesis and shows the consequences for the legal assessment of the Corona measures on the basis of the principle of proportionality. The text concludes by calling for a consistent end to the continuing remnants of the state of deviation from the normal state of affairs, since there is no longer a national emergency
