La autonomía del Estado y el imperio de la ley: notas para una teoría del Estado desarrollista

El papel del Estado en el proceso de desarrollo es función de su capacidad de cumplir con sus responsabilidades constitucionales y en particular de aplicar la ley. El poder limitado que tiene para hacer cumplir el imperio de la ley limita a su vez el papel desarrollista del Estado en América Latina, y esa limitación es el resultado de la fragmentación del control social que prevalece en el área.
The role that the State plays in the development process is a function of its own capacity to fulfill its constitutional obligations,and in particularto implementthe rule of law. This limited power that the State has to enforce the rule of law in turn limits the developmentalistrole of the State in Latin America, and that limitationis the result of the fragmentationof social control which prevails in the area.
