Ist die staatliche Risikoübernahme bei Terrorismusrisiken mit dem europäischen Wettbewerbsrecht vereinbar?

After the terrorist attacks of September 11, there is a controversial discussion in Germany, whether the state should be liable for such risks like terrorism risks that are generally considered as 'not insurable'. As a result of the events of September 11, the Extremus AG which offers insurance cover against terrorism risks in Germany has been established with participation of the German state. It is questionable, whether such a state participation at Extremus AG represents an inadmissible state financial assistance according to the article 87 EGV (European Community Contract). It has been shown that state financial assistances given to Extremus AG are exceptionally permitted.
