Paulus oder Ulpian? Zur Authentizität einer Inskription in D. 10.1

Zusammenfassung: Der Beitrag erörtert die Authentizität einer Inskription im Digestentitel Finium regundorum (D. 10, 1), die nur die gesonderte Überlieferung dieses Titels innerhalb einer agrimensorischen Sammlung aufweist, während sie im Codex Florentinus, in den mittelalterlichen Digestenhandschriften sowie in den Basiliken fehlt. Nach dieser Inskription stammt das Ende von D. 10, 1, 2 (Et si forte – condemnationem) aus Paulus, 23 ed., nach der sonstigen Überlieferung rührt D. 10, 1, 2 insgesamt aus Ulpian, 19 ed. her. Die Authentizität der Inskription ist aber nicht nur für die Textzuordnung, sondern auch für die Frage nach der äußeren Gestalt des Digestentextes von Bedeutung. Die unterschiedliche Textgestalt der Handschriften dürfte nicht überlieferungsbedingt sein, sondern auf einen Fehler bei der Redaktion der Digesten zurückgehen, wie mehrere parallele Befunde im Codex Florentinus nahelegen.
Zusammenfassung: The contribution examines the authenticity of an inscription in the Digest-title Finium Regundorum (D.10,1). The only source for this inscription is a collection of texts for use by agrimensores. The inscription is not extant in the Codex Florentinus or in medieval manuscripts of the Digest. According to the inscription, the end of D.10,1,2 (Et si forte – condemnationem) is an excerpt from Paulus, 23 ed. All other sources say Ulpian, 19 ed is the source of the complete D.10,1,2. Apart from its pertinence to the question of the passage’s origin, the inscription is also a source of information about the text of the Digest. Several parallel cases in the Codex Florentinus suggest that the difference probably did not develop over the course of the tradition of the text, but stems from a mistake made during the edition of the Digest
